This privacy policy (Policy) applies to all personal information collected by Ultraceuticals Pty Limited (ACN 080 758 201) (Ultraceuticals, we, us, our) and Renaissance Products Limited (registered in Ireland with registered number 176849) (Renaissance, we, us our) respectively (each a Controller, we us, our) through the website www.ultraceuticals.com/ie which is operated by the Controllers (the Site”).   We each understand that your personal information is important to you and it is also important to us.  This Policy tells you what personal information each of us processes, what we use it for and explains your rights around how we use it.  Our respective privacy procedures comply the EU General Data Protection Regulation (GDPR).

Ultraceuticals

We use the personal information we collect about you for the following purposes:  

(a)   to communicate with you and to provide you with our monthly newsletter (if you have indicated you wish to receive marketing materials); and

(b)   to carry out marketing research, and to assist us in performing our functions and activities;

(c)   to identify lookalike audiences (customers who have similar interests to you) for Facebook Advertising;

(d)   to share your names and products ordered with your preferred salon (where you have opted into share this information with your preferred salon).

We use the personal information we collect about you for the following purposes:  

(a)   to identify and process your order;

(b)   to personalise your shopping experience with us;

(c)   to verify your identity when you use the website, and to assist you if you forget your username or password for any of the services we provide to you via the website;

(d)   to communicate with you and to provide you with our monthly newsletter (if you have indicated you wish to receive marketing materials).

DISCLOSURE

Ultraceuticals and Renaissance are each dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured. However, either Renaissance or Ultraceuticals may disclose your personal information as follows:

Affiliates and group companies

A Controller may disclose your personal information to its group companies and affiliates for the administration and management of its business and compliance with applicable laws rules and regulations, and internal policies and procedures across our group (including statutory reporting and disclosures to regulatory authorities).

A Controller may disclose your personal information to a governmental or regulatory body (including tax authorities, law enforcement agencies and financial regulators) in order to comply with a legal obligation or to any person pursuant to an order of a court or tribunal.

A Controller may also disclose your information to its solicitors, auditors, insurance advisors and financial services advisors to the extent required to allow them to provide professional services to it.

Business partners, suppliers [and advertisers]

A Controller may share your information with selected third parties including:

(i)         Business partners, suppliers and sub-contractors for the performance of any contract it enters into with them or you including by way of example our website hosting provider

(ii)        Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others.

(iii)       Analytics and search engine providers that assist the Controller in the improvement and optimisation of its products or services.

(i)         In the event that the Controller sells or buy any business or assets, in which case the Controller may disclose your personal data to the prospective seller or buyer of such business or assets.

(ii)        If the Controller or substantially all of its assets are acquired by a third party, in which case personal data held by the Controller about its customers will be one of the transferred assets.

(iii)       If the Controller is under a duty to disclose or share your personal data in order to comply with any legal obligation and agreements; or to protect its rights, property, or safety or those of our customers, or others.

Your personal information may be disclosed where you yourself have disclosed such information as a result of submitting a review on the Site or posting content to the Controller’s social media platforms. This is because the reviews you submit or the content you post are visible to anyone who may access the Site or social media accounts from time to time.

OVERSEAS TRANFERS

The Site is hosted and supported by Ultraceuticals whose servers are located in Australia.  Appropriate safeguards are in place to protect the transfer of your personal data to Australia. You may contact either us to find out more or to obtain a copy of the appropriate safeguards.

ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

Each Controller take steps reasonable in the circumstances to ensure the personal information it holds is accurate, up-to-date, complete, relevant and not misleading. You have a right to access and/or seek correction of your personal information that is collected and held by either Controller.

You also have the right to request that a Controller:

(a)   stop processing personal data relating to you (‘right to object’).

(c)   under certain circumstances, erase your personal data without undue delay (i.e. the “right to erasure”). and

(d)   under certain circumstances, furnish you with the personal data which you provided us with in a structured, commonly used and machine-readable format (‘right to data portability’).

Where a Controller processes your data solely based on your consent, you are entitled to withdraw your consent at any time.  This will not affect the lawfulness of processing before the withdrawal.

You also have the right to lodge a complaint with the Data Protection Commission of Ireland at any time. 

The exercise of your rights might be subject to certain conditions and a Controller might require further information from you before it can respond to your request.

If you believe that Ultraceuticals has breached your privacy rights, you can make a privacy complaint to us by emailing digital@ultraceuticals.com.au

If you believe that Renaissance has breached your privacy rights, you can make a privacy complaint by emailing info@renaissanceproducts.com.

You also have the right to lodge a complaint with the Data Protection Commission of Ireland at any time. 

At all times, privacy complaints will be treated seriously, dealt with promptly and in a confidential manner; and will not affect your existing obligations or affect your commercial arrangements with us (if any).
